In these terms:

  • •"Eviron", "we", "us" and "our" mean Eviron Ltd.
  • •"Customer", "you" and "your" mean the person or business requesting or purchasing our services.
  • •"Consumer" means an individual purchasing services mainly for personal rather than business purposes.

2. Application of these terms

2.1 These terms apply to estimates, quotations, bookings and waste-removal services supplied by Eviron.

2.2 Customers should read these terms before accepting a final quotation.

2.3 Nothing in these terms excludes or restricts statutory consumer rights, including the right to receive services performed with reasonable care and skill.

3. Website estimates

3.1 Prices generated through the website are estimates only.

3.2 Website estimates are based on the information provided by the customer, including:

  • •Waste type;
  • •Approximate volume;
  • •Estimated weight;
  • •Individual items;
  • •Photographs;
  • •Collection address;
  • •Access conditions; and
  • •Labour requirements.

3.3 Submitting an estimate request does not create a contract, confirm a final price or reserve a collection appointment.

3.4 Eviron will review the submitted information and may request further information or photographs.

3.5 Following the review, Eviron will provide or confirm a final quotation.

3.6 The final quotation may differ from the website estimate where the information supplied affects the volume, weight, disposal cost, labour, access, travel or waste classification.

3.7 Website estimates and quotations do not include waste or work that was not disclosed by the customer.

4. When a booking becomes confirmed

4.1 A contract is formed only when:

  • •Eviron provides or confirms the final quotation;
  • •The customer accepts the final quotation and these terms; and
  • •Eviron confirms the collection booking.

4.2 Submitting an estimate request does not start the legal cooling-off period because no contract is formed at that stage.

4.3 A booking confirmation may identify the collection address, waste, final quotation, collection arrangements, payment method and applicable charges.

4.4 Unless expressly stated otherwise, a quotation covers only the waste, labour and access conditions described when it was issued.

5. Customer information and photographs

5.1 The customer must provide accurate and complete information about:

  • •The type and approximate quantity of waste;
  • •All items requiring collection;
  • •Heavy or dense materials;
  • •Upholstered furniture, mattresses and electrical items;
  • •Fridges, freezers and tyres;
  • •Hazardous or potentially hazardous materials;
  • •Stairs, parking restrictions and carrying distances;
  • •Access through buildings or gardens; and
  • •Anything else that could affect the collection.

5.2 Photographs must show the complete collection as clearly as reasonably possible.

5.3 Customers must not deliberately exclude or conceal waste from photographs.

5.4 Heavy materials—including soil, rubble, concrete, bricks, tiles and plasterboard—must be disclosed separately.

5.5 The customer must notify Eviron if the waste or access conditions change after the quotation is provided.

6. On-site assessment and revised prices

6.1 Eviron's collection team may assess the waste and access before loading begins.

6.2 If the collection materially matches the information supplied, the agreed final quotation will apply.

6.3 If the quantity, weight, waste type, individual items, labour or access conditions are materially different, Eviron may:

  • •Provide a revised price;
  • •Exclude particular items;
  • •Offer to collect only the originally agreed waste; or
  • •Refuse the collection where it cannot be completed safely or lawfully.

6.4 Eviron will explain any revised price before loading materially different or additional waste.

6.5 The customer may accept or decline the revised price.

6.6 Extra waste added after loading begins will be subject to an additional price agreed with the customer.

7. Guide prices, volumes and weight allowances

7.1 Website prices are guide prices only. The customer's submission will be reviewed before Eviron confirms the final quotation.

7.2 Guide prices assume that:

  • •The waste has been accurately described;
  • •Clear photographs show the complete collection;
  • •Access and loading conditions are reasonable;
  • •No prohibited or undeclared specialist waste is included; and
  • •The stated volume and weight allowances are not exceeded.

Mixed-waste guide prices

Load sizeGuide priceIncluded weight
Mini load – 2 cubic yards£140150kg
Small load – 4 cubic yards£220300kg
Medium load – 6 cubic yards£300450kg
Large load – 8 cubic yards£360600kg
Large+ load – 10 cubic yards£410750kg
Full load – 12 cubic yards£450900kg

7.3 Mixed-waste loads exceeding their included weight allowance will be charged at £15 for each additional 50kg.

7.4 Where the excess is not an exact multiple of 50kg, it will be rounded up to the next 50kg.

Example: A 6-cubic-yard mixed load includes 450kg. If it weighs 530kg, it is 80kg overweight and the additional charge is £30.

7.5 Where available, Eviron may use the disposal facility's recorded weight to calculate the charge.

7.6 Heavy materials must be disclosed because a load may reach its weight allowance before reaching its volume allowance.

Wood-waste guide prices

Load sizeGuide priceIncluded weight
Half load – 6 cubic yards£180500kg
Full load – 12 cubic yards£3401,000kg

7.7 Wood-waste loads exceeding their included weight allowance will be charged at £15 for each additional 100kg.

7.8 Where the excess is not an exact multiple of 100kg, it will be rounded up to the next 100kg.

7.9 Wood-waste pricing applies only where the load consists primarily of acceptable wood.

7.10 Contamination with general waste, upholstered furniture, hazardous material, plasterboard, soil or rubble may result in the load being reclassified or repriced.

Green-waste guide prices

Load sizeGuide priceGuide weight allowance
Half load – 6 cubic yards£150500kg
Full load – 12 cubic yards£2501,000kg

7.11 Green-waste pricing applies to suitable garden waste, including branches, hedge cuttings, grass, leaves and plants.

7.12 A green-waste load may contain no more than 100kg of soil in total.

7.13 If more than 100kg of soil is included, Eviron may:

  • •Remove the excess soil from the green-waste quotation;
  • •Reclassify it as mixed or hardcore waste;
  • •Provide a revised price; or
  • •Refuse to collect the excess material.

7.14 Green-waste weight allowances are guides rather than an automatic overweight charging scale.

7.15 All loads must remain within the vehicle's safe and legal carrying capacity.

Clean-hardcore guide price

Load sizeGuide priceMaximum weight
4 cubic yards£2502,000kg

7.16 Clean-hardcore pricing applies only to suitable separated materials agreed by Eviron, such as uncontaminated bricks, concrete, rubble and certain tiles.

7.17 Soil, plasterboard, general waste, wood, packaging, hazardous material or other contamination must not be mixed into a clean-hardcore collection unless agreed beforehand.

7.18 There is no standard automatic overweight rate for clean-hardcore collections.

7.19 Eviron will not exceed a vehicle's safe or legal weight limit. Additional material may require a separate collection and quotation.

General pricing rules

7.20 Volume and weight allowances operate together. A customer purchases a stated load size subject to its applicable weight allowance.

7.21 Unused volume does not permit a weight allowance or legal vehicle limit to be exceeded.

7.22 Green waste and clean hardcore do not use the mixed-waste overweight rate of £15 per additional 50kg.

7.23 Separately chargeable items may include:

  • •Upholstered seating containing persistent organic pollutants;
  • •Mattresses;
  • •Televisions and monitors;
  • •Fridges and freezers;
  • •Tyres; and
  • •Other items requiring separate handling or disposal.

7.24 Separately chargeable items are not included unless shown in the estimate or final quotation.

7.25 Additional loading time may be charged at £15 for each additional 15 minutes where the agreed allowance is exceeded because of additional waste, difficult access, waiting time or circumstances not disclosed before booking.

7.26 A call-out charge will apply only where it was disclosed before the booking was confirmed.

7.27 Any additional price caused by excess weight, volume, contamination or materially different waste will be explained as soon as reasonably possible.

7.28 Where the difference can be identified before loading, the customer's agreement will be obtained before proceeding.

8. Payment

8.1 Payment must be made by:

  • •Bank transfer against an official Eviron Ltd invoice; or
  • •Cash upon collection.

8.2 Eviron does not accept card payments through the website.

8.3 The payment method and due date will be stated in the final quotation, booking confirmation or invoice.

8.4 Customers should only transfer money using bank details shown on an official Eviron invoice or confirmed through Eviron's published contact details.

8.5 Unless otherwise agreed, payment is due upon completion of the collection.

8.6 Eviron may require payment before the vehicle leaves the collection address.

8.7 Business customers must pay undisputed invoices by the stated due date. Where legally permitted, statutory interest and recovery costs may be added to overdue business invoices.

9. Access and customer responsibilities

9.1 The customer must ensure that:

  • •Eviron has safe and lawful access;
  • •The waste is ready at the agreed time;
  • •Suitable parking or loading access is available;
  • •Any required parking permission has been obtained;
  • •The customer has authority to remove the waste;
  • •The customer has authority to give Eviron access;
  • •Children and animals are kept away from the working area; and
  • •Relevant access and safety risks have been disclosed.

9.2 Where waste must be carried through a building, the customer should protect vulnerable floors, walls, doors, fixtures and furniture.

9.3 The customer must disclose fragile surfaces, weak structures, hidden services and areas requiring special protection.

9.4 Eviron may stop or refuse work where conditions are unsafe, unlawful or materially different from those disclosed.

9.5 The customer must not place additional items on the vehicle without permission.

10. Prohibited and hazardous waste

10.1 Unless expressly agreed in writing, Eviron does not collect:

  • •Asbestos or suspected asbestos;
  • •Clinical or infectious waste;
  • •Needles, syringes or sharps;
  • •Explosives, ammunition or fireworks;
  • •Radioactive material;
  • •Gas cylinders or pressurised containers;
  • •Chemicals, solvents, oil, fuel or paint;
  • •Unidentified liquids;
  • •Human or animal remains;
  • •Sealed containers with unknown contents; or
  • •Waste requiring specialist permissions or equipment Eviron does not hold.

10.2 Hazardous, contaminated or potentially dangerous waste must be disclosed before booking.

10.3 Prohibited items must not be hidden inside bags, cabinets, containers or other waste.

10.4 If prohibited or dangerous waste is discovered, Eviron may stop work and refuse to collect it.

10.5 Where a customer incorrectly describes or conceals prohibited waste, the customer may be responsible for reasonable costs directly caused by it, subject to consumer law.

11. Cancellations and rescheduling

11.1 Cancellation and rescheduling requests must be sent to support@evironltd.com or made by calling 01788 221978.

11.2 Customers should provide their name, collection address and booking reference.

11.3 Eviron's standard cancellation policy requires at least 48 hours' notice before the scheduled collection time.

11.4 Where at least 48 hours' notice is provided, no standard cancellation charge will apply.

11.5 Where less than 48 hours' notice is provided, Eviron may charge a cancellation fee of up to £75 to cover reasonable losses caused by the cancellation, including reserved vehicle time, staffing, administration and travel arrangements.

11.6 A cancellation charge will not exceed Eviron's reasonable loss.

11.7 No cancellation charge will apply where:

  • •Eviron is responsible for the cancellation;
  • •Eviron has suffered no reasonable loss;
  • •Eviron can reasonably avoid or recover the loss; or
  • •The customer is validly exercising a statutory right to cancel without charge.

11.8 If Eviron attends but cannot complete the collection because the customer is absent, access is unavailable, the waste was materially misdescribed or the agreed booking requirements were not met, an aborted-attendance charge of up to £75 may apply.

11.9 Any aborted-attendance charge will be limited to Eviron's reasonable loss.

12. Consumer cooling-off period

12.1 A consumer who accepts a final quotation online, by telephone, email, WhatsApp or away from Eviron's business premises normally has a legal 14-day cooling-off period.

12.2 The cooling-off period begins the day after the contract is formed.

12.3 The contract is formed when:

  • •The customer accepts the final quotation and these terms; and
  • •Eviron confirms the booking.

12.4 Submitting a website estimate request does not begin the cooling-off period.

12.5 A qualifying consumer may cancel during the cooling-off period by sending a clear request to support@evironltd.com.

12.6 If the customer wants the collection performed before the cooling-off period ends, Eviron will obtain the customer's express request to begin the service during that period.

12.7 If the customer validly exercises the statutory right to cancel before the service begins, no cancellation charge will apply.

12.8 If the customer expressly requested that the service begin during the cooling-off period and cancels after work has started, Eviron may charge a proportionate amount for work already supplied.

12.9 Once the collection has been fully completed following the customer's express request and acknowledgement, the statutory right to cancel the completed service ends.

12.10 These statutory cooling-off provisions apply to qualifying consumers and do not generally apply to customers contracting wholly or mainly for business purposes.

12.11 Nothing in Eviron's 48-hour policy removes or restricts statutory cancellation rights.

13. Arrival times and delays

13.1 Collection times and arrival windows are estimates unless expressly guaranteed in writing.

13.2 Delays may be caused by traffic, disposal-site queues, weather, vehicle problems, previous collections or events outside Eviron's reasonable control.

13.3 Eviron will take reasonable steps to notify the customer of a significant delay and arrange a revised time where necessary.

13.4 Nothing in this section affects statutory rights where Eviron fails to provide the service within a reasonable time or by an agreed essential deadline.

14. Loading and disposal

14.1 Eviron may assess the load before work begins.

14.2 Eviron will transport collected waste only to an authorised facility or another lawful destination.

14.3 Waste becomes Eviron's responsibility after it has been loaded onto the vehicle, subject to payment and legal requirements.

14.4 Eviron may provide invoices, receipts, collection confirmations and waste documentation electronically.

15. Damage

15.1 Eviron will perform the service with reasonable care and skill.

15.2 The customer must disclose fragile surfaces, hidden services, weak structures and special protection requirements before work begins.

15.3 Eviron is not responsible for:

  • •Pre-existing damage;
  • •Ordinary wear;
  • •Damage caused by unsafe or defective premises;
  • •Damage caused by inaccurate instructions; or
  • •Minor marking that could not reasonably be avoided when moving bulky items through restricted access.

15.4 This does not exclude responsibility where Eviron failed to exercise reasonable care and skill.

15.5 Alleged damage should be reported as soon as reasonably possible to support@evironltd.com.

15.6 The report should include the booking reference, details and supporting photographs.

15.7 Eviron must be given a reasonable opportunity to inspect reported damage and provide an appropriate remedy.

15.8 A delay in reporting does not automatically remove the customer's legal rights.

16. Complaints

16.1 Complaints should be sent to support@evironltd.com or posted to:

Eviron Ltd

1 Bridge Street

Rugby

England

CV21 3NR

16.2 Complaints should include the customer's name, collection address, booking reference, details of the complaint and relevant evidence.

16.3 Eviron will investigate complaints fairly and respond within a reasonable time.

17. Liability

17.1 Nothing in these terms excludes or restricts liability for:

  • •Death or personal injury caused by negligence;
  • •Fraud or fraudulent misrepresentation;
  • •Breach of statutory consumer rights; or
  • •Liability that cannot legally be excluded.

17.2 Eviron is responsible for reasonably foreseeable loss or damage caused by a breach of contract or failure to exercise reasonable care and skill.

17.3 Eviron is not responsible for losses that were not reasonably foreseeable when the contract was formed.

17.4 Eviron is not responsible for business losses suffered by a customer acting as a consumer.

17.5 Business customers should arrange suitable insurance for indirect loss, loss of profit, loss of opportunity and business interruption.

17.6 Subject to clause 17.1 and to the extent permitted by law, Eviron's total liability to a business customer arising from a booking will not exceed the total amount payable for that booking.

18. Personal information

18.1 Eviron processes personal information in accordance with its Privacy Policy.

18.2 Privacy requests and marketing opt-outs should be sent to support@evironltd.com.

19. Website use

19.1 Website descriptions, photographs and load examples are guides only.

19.2 Waste volume varies depending on how items are shaped, dismantled and loaded.

19.3 The weight of visually similar loads can vary considerably.

19.4 Customers must not knowingly submit false, misleading, unlawful or harmful information.

19.5 Eviron does not guarantee that the website will always be available or free from technical errors.

20. Changes to these terms

20.1 Eviron may update these terms to reflect changes to services, prices, processes or legal obligations.

20.2 The version accepted when a booking is confirmed will apply to that booking.

20.3 Eviron will not retrospectively change an accepted contract without the customer's agreement unless required by law.

21. General provisions

21.1 If part of these terms is found unlawful or unenforceable, the remaining terms will continue to apply.

21.2 A delay in enforcing a right does not waive that right.

21.3 No person other than Eviron and the customer has a right to enforce the contract, except where the law provides otherwise.

21.4 These terms and disputes arising from them are governed by the law of England and Wales.

21.5 Consumers retain any mandatory right to bring proceedings in another applicable UK court.
